LEXINGTON
SKI AND SPORTS CLUB/OHIO VALLEY SKI COUNCIL, INC. –
TERMS AND CONDITIONS OF
MEMBERSHIP
The
applicant acknowledges that hazards are inherent in
the sport of skiing and other activities
participated in by club members and their guests,
and assumes all risks of injuries or damages
incidental to such activities.
In consideration of the mutual benefits derived
from participation of membership in the Lexington
Ski and Sports Club, Inc./OVSC, in skiing and all
other activities, the undersigned does hereby
absolve, release, and waive any and all liability,
claims, or demands against the Lexington Ski and
Sports Club, Inc./OVSC, its officers, directors,
agents, and each and every member thereof, which
may arise out of, or be related to, any injury,
damages, or pecuniary loss by reason of such
membership or activity or participation in said
organization, including, but not limited to, all
causes arising out of nonfeasance, malfeasance, or
negligence of the Lexington Ski and Sports Club,
Inc./OVSC, its officers, directors, agents, and
each and every member thereof.
Any
member or guest of the Lexington Ski and Sports
Club, Inc./OVSC, attending an event, or using the
property of, or loaning to another his property for
use on or in land, water or air at any Lexington
Ski and Sports Club, Inc./OVSC event or function
does so at the member's or guest's own risk and
said member or guest waives any and all claims
against the Lexington Ski and Sports Club,
Inc./OVSC, its officers, directors, agents, and
each and every member thereof, regardless of who
uses and/or causes any damages to said
property.
FAMILY:
The applicant, as parent(s) and/or guardian(s) of
the minor children listed herein, for the
consideration set forth above, do hereby further
release, acquit, discharge, and covenant to hold
harmless the Lexington Ski and Sports Club,
Inc./OVSC, its officers, directors, agents, and
each and every member thereof, from any and all
liability, claims, or demands arising out of, or
from, participation in said club or related
activities by said minors.
The
applicant further promises to bind himself jointly
and severally, his heirs, administrators, and
executors, to repay to the Lexington Ski and Sports
Club, Inc./OVSC, its officers, directors, agents,
and/or each and every member thereof any sum of
money that any of said parties may hereafter be
compelled to pay on behalf of a minor child or
guest because of such claim.
POLICY
STATEMENT: The Lexington Ski and Sports Club,
Inc./OVSC, reserves the right to terminate the
membership of any member or refuse renewal thereof
for good reasons, known only and decided by the
majority of the directors of the Lexington Ski and
Sports Club, Inc./OVSC. In such event, the sole
liability of the Lexington Ski and Sports Club,
Inc./OVSC shall be the refund of the membership
dues paid during the year.
RULES OF
CONDUCT: In order to promote goodwill and
relaxation at Lexington Ski and Sports Club,
Inc./OVSC activities, parties, trips, meetings,
etc., it shall be the duty of the person in charge
of such activity or any director to eject anyone
from that activity whose behavior exceeds the
bounds of good taste or who participates in illegal
acts. Such person shall be subject to expulsion
from the Lexington Ski and Sports Club, Inc./OVSC
if deemed necessary by the board of directors.
I
acknowledge that I have read the above Release and
Hold Harmless Agreement, Policy, and Rules of
Conduct, and I agree to abide by same, and as may
be revised from time to time, upon pain of loss of
membership for failure to comply with any or all.
The information submitted via online application is
correct in its entirety and I agree as a condition
of membership to complete and sign a paper
application for the records of the LSSC.
